台化彰化廠汽電共生廠被勒令停爐熄火剛滿1年，最近再爆出彰化縣環保局追溯從民國97年開始，加重裁罰不法利得共12億元；台化以環保局從未依規定稽查並限期改善，更有行政疏失，反駁裁罰沒道理，這場國內最高環保裁罰金額的角力浮上檯面，引起產業界議論。

環保局決定追溯、加重裁罰的理由，是台化彰化廠汽電共生廠M22鍋爐在民國91年開始操作後使用的生煤，一直「未履行」當時在環評會議所作的「承諾」，造成空氣汙染，危害彰化市民的健康。

會議中所作的「承諾」，是共識、是結論，但不是依法制訂的規定或法律，有多少約束效力，有沒有法律責任？都值得探究。這項創下國內天價的環保裁罰案，台化一定會提出訴願，依經驗法則，行政院環保署站在環保局這一邊，是可預期，最後還是走上行政訴訟。

3年前，高雄市楠梓工業區日月光K7廠違法排放未經處理的廢水裁罰2億多元；2年前，六輕工業區台塑麥寮廠將製程生產的石灰事業廢棄物委外清運，業者載到台南亂倒致汙染土壤，被罰1億4千多萬元。兩市環保局都在行政訴訟中敗訴，兩大企業都逆轉勝。

行政法院會撤銷台南、高雄環保局的裁罰處分，癥結都在環保局有明顯的行政疏失，一則未定期稽查並限期改善，二來無法提出企業不法利得的具體數據，也拿不出造成危害人體健康的明確事證，遭質疑是天馬行空的想像。

博客來台化彰化廠案更有趣，10年前、5年前台化兩度在鍋爐操作許可的5年期限屆滿前，依法申請展延，彰化縣環保局都無異議核准；所以法界人士普遍認為，彰化縣環保局的追溯與加重裁罰之舉，是挑戰「不可能的任務」，宣誓意義大於一切。024071734.jpg&x=0&y=0&sw=0&sh=0&sl=W&fw=>台化彰化廠去年被勒令鍋爐熄火，最近彰化縣環保局再追溯裁罰12億元不法利得。記者何烱榮／攝影
